How to keep up-to-date with new Right to Work Checks
If you haven’t already heard, the Covid-19 adjusted right to work checks that were introduced in March 2020 is being scrapped. The government’s new guidance now states that from the 1st of October 2022, employers will have to carry out new legislative right to work checks to prevent getting fined.
With this new legislation, digitisation will essentially be key for recruiters to save time while carrying out right to work checks.
Recruiters can carry out checks in one of three ways:
- Manual right to work checks will still be in place, but with the new legislation from the 1st October, this won’t be mandatory and many recruiters are finding this way to be too time consuming. These right to work checks will cover British and Irish nationals who need permission to work in the UK and will require face to face meetings.
- From the 6th April 2022, foreign nationals who hold a biometric residence card, a biometric residence permit or a frontier worker permit can be checked online through the government website rather than manually or face to face. Candidates will need to provide their date of birth and share code with the employer/ recruiter to verify their status through the government’s online checking service which can take time to verify.
3. From October 1st 2022, employers can use a certified identity service provider (IDSP) to complete right to work checks for any citizen holding a valid passport. This is a more streamlined way to manual checks and is something that will benefit most employers/ recruiters. All candidates have to do is submit their information along with a photo of their passport digitally and a verified identity document validation technology (IDVT) will review these documents and most of the time will instantly give a validation for the UK or Irish citizen.
Ultimately, this way of right to work checks will help recruiters save more time, complete secure checks that can be carried out from your smartphone.
